This Acceptable Use Policy (“Policy”, “AUP”) sets out the rules governing the use of the empathAIse platform (“Platform”) provided by FitCode Pte. Ltd. (“we”, “us”, “our”).
By using the Platform, you (“Customer”, “you”, “your”) agree to comply with this Policy.
Violation of this Policy may result in suspension, restriction, or termination of your account, without refund.
This Policy applies to all users, employees, contractors, and individuals authorised to use your empathAIse account.
1. General Principles
You must use the Platform:
In a lawful, responsible, and ethical manner
In compliance with all applicable laws (PDPA, GDPR, CAN-SPAM, TCPA, etc.)
Without causing harm, disruption, or risk to empathAIse infrastructure or third parties
You are responsible for all activities conducted under your account.
2. Prohibited Activities
The following activities are strictly prohibited.
2.1 Unlawful, Harmful, or Offensive Content
You must not upload, create, transmit, or promote content that contains:
Illegal material
Hate speech, violence, harassment, or abuse
Threats or intimidation
Discrimination (race, gender, religion, disability, etc.)
Pornographic or sexually explicit content
Child sexual content (zero tolerance – immediate termination)
Defamation or slander
Fraudulent claims or misrepresentation
Malware, ransomware, spyware, or harmful code
2.2 Misuse of Messaging Channels (SMS, WhatsApp, Email, Voice)
You must not:
Send unsolicited messages (“spam”) without consent
Use purchased, scraped, or illegally acquired contact lists
Violate PDPA’s Do-Not-Call (“DNC”) rules
Send deceptive, misleading, or harmful messages
Impersonate individuals or brands
Send mass messages without proper opt-in
Use the Platform to send phishing or fraudulent communications
Carriers or providers may block or restrict messages that violate compliance rules. empathAIse is not liable for such actions.
2.3 High-Risk or Restricted Industries
Unless pre-approved in writing, you may not use the Platform for:
Gambling or betting
Adult entertainment
Get-rich-quick schemes
Payday loans or unlicensed financial services
Crypto/FX schemes
Political campaigning
Multi-level marketing (MLM)
Sale or promotion of weapons or explosives
Promotion of illegal drugs
2.4 Security Violations
You must not:
Attempt to circumvent authentication systems
Attempt unauthorised access to any account or system
Probe, scan, or test the vulnerability of the Platform
Perform denial-of-service (DoS/DDoS) attacks
Interfere with or disrupt Platform operations
Use the Platform in a way that imposes excessive technical load
2.5 Data Protection & Privacy Violations
You must not:
Collect or process personal data without proper consent
Upload sensitive personal data without justification and permission
Share customer or user data without authority
Upload medical, health, financial, or government ID data unless lawful
Breach PDPA, GDPR, or similar privacy laws
Store unencrypted sensitive data in plaintext
Attempt to deanonymise anonymised data
2.6 Intellectual Property Violations
You must not:
Upload or use copyrighted materials without permission
Infringe trademarks or intellectual property rights
Use the Platform to host pirated content
2.7 AI Misuse
You must not use AI features for:
Generating harmful or misleading content
Automated harassment or manipulation
Creating deepfakes of real individuals without permission
Legal, financial, or medical decision-making without expert review
Discriminatory or unethical automated decisions
Inputting sensitive personal data into AI prompts unless strictly lawful
AI outputs must always be reviewed by a human before use.
2.8 Prohibited Commercial Use
You may not:
Resell access to the Platform
Offer white-labelled versions of the Platform
Act as an agency, SaaS reseller, or distributor
Provide the Platform as a service to third parties
Share your account with unrelated businesses
Your subscription is strictly for your internal business use.
3. System & Resource Abuse
The following are prohibited:
Excessive API calls that overload systems
Abnormal email/SMS sending patterns
Running unsupported automations or scripts
Using the Platform for hosting non-business files
Storing illegal content of any kind
If your usage threatens system stability, empathAIse may throttle, restrict, or suspend access.
4. Third-Party Platforms & Integrations
When using WhatsApp, SMS, email providers, payment processors, or social media APIs, you must comply with their policies.
Examples include:
Meta/WhatsApp Commerce Policy
Twilio messaging rules
Google and Apple developer terms
Email authentication requirements (DKIM, SPF, DMARC)
Violations may result in third-party blocking, account suspension, or financial penalties — which empathAIse may pass through to you.
5. Reporting Violations
To report misuse or policy violations, contact:
Include:
Your name and organisation
URL or screenshot of violation
Description of incident
empathAIse investigates all reports.
6. Enforcement & Actions
If empathAIse determines that you have violated this AUP, we may, at our sole discretion:
Issue a warning
Suspend specific features (e.g., messaging channels)
Restrict account access
Require corrective action
Temporarily or permanently suspend your account
Terminate your subscription without refund
Report illegal activity to authorities
Seek compensation for damages or legal costs
We may take action without prior notice if necessary to:
Protect the Platform
Comply with legal obligations
Prevent harm to other customers or the public
7. Changes to this AUP
We may update this AUP from time to time.
Your continued use of the Platform constitutes acceptance of updated terms.
